DO ALL ESTATES HAVE TO GO THROUGH PROBATE?ย 

No. Many assets transfer automatically through beneficiary designations, joint ownership, or trusts. Whether probate is necessary depends on how each asset was titled at the time of death. 

HOW LONG DOES PROBATE TAKE IN MICHIGAN?ย 

Every estate is different. 

Simple estates may conclude within several months, while larger or more complex estates involving real estate, tax issues, litigation, or creditor claims often take longer. 

WHAT IS THE DIFFERENCE BETWEEN FORMAL AND INFORMAL PROBATE?ย 

Michigan offers both formal and informal probate procedures.

CAN PROPERTY BE SOLD BEFORE PROBATE IS COMPLETE?ย 

Often yes. 

Depending on the circumstances and the authority granted under Michigan law or by court order, a Personal Representative may sell estate property before final distribution. 

DO BENEFICIARIES RECEIVE INFORMATION ABOUT THE ESTATE?ย 

Yes. 

Michigan law requires Personal Representatives to provide certain notices and information to interested persons. Beneficiaries are also entitled to receive an accounting before the estate is closed unless that requirement is properly waived. 

WHAT HAPPENS IF SOMEONE DIES WITHOUT A WILL?ย 

Michigan’s intestate succession laws determine who inherits property. The Probate Court still appoints a Personal Representative to administer the estate, but the distribution follows the statutory order established by Michigan law rather than the deceased person’s wishes.
